NOTICE OF NON-LIABILITY DUE TO PHYSICAL EXCLUSION FROM PREMISES

This letter serves as formal notice to AES Indiana (and all other utility providers) that I, Cody Rice-Velasquez, was physically excluded and removed from the property at [Property Address] on December 9, 2024, at 1:00 PM, pursuant to a Writ of Assistance executed by the Marion County Sheriff.

As of that date and time:

  1. Possession Transferred: Legal possession and control of the premises transferred to the Plaintiff in Case No. 49D03-2501-MF-002559 (First Community Federal Credit Union).
  2. Lack of Access: I have been denied all keys, passcodes, and physical access to the property. I am unable to enter the structure to manually disable appliances, adjust the thermostat, or stop the consumption of utilities.
  3. Unauthorized Consumption: Any consumption of electricity, water, or gas at the property after December 9, 2024, at 1:00 PM is the result of the actions of the Plaintiff or their agents (the bank), who have reportedly left the doors open and the heat running uncontrollably.

DEMAND: I demand that all liability for utility consumption at this address be transferred to the current possessor (FCFCU) as of December 9, 2024. Any bills generated for service after this date are in dispute.

I am disabled and entitled to protections under the ADA. This exclusion and continued billing while I am locked out constitutes a significant hardship. Please update your records immediately and provide a confirmation of this dispute.
