AFFIDAVIT OF OBSERVATIONS

I, [Affiant Full Name], being first duly sworn upon my oath, depose and say:

  1. Identity: I am over the age of eighteen (18) and reside at [Affiant Address].

  2. Basis of Knowledge: I am a [Relation, e.g., neighbor/family member/frequent visitor] to Cody Rice-Velasquez. Between February 2025 and May 2025, I visited Cody’s residence at 4817 Shadow Pointe Drive approximately [Number] times per week.

  3. Observation of Physical Presence: During the months of March and April 2025, I personally observed Cody to be physically present at the residence during the day and evening. Because of his [Disability/Work Schedule], he was almost always home when I visited or passed by.

  4. Observation of Service/Notice: During my frequent visits in the Spring of 2025, I never observed any legal documents, summons, or “notice of service” taped to the front door or left in a conspicuous place.

  5. Observation of Mail: I have on occasion [e.g., helped Cody bring in the mail / seen the mail on the counter]. I never observed any correspondence from Financial Center First Credit Union or the Marion County Sheriff’s Office that appeared to be a legal summons or foreclosure complaint.

  6. Observation of Disability Impact: I have personally observed how Cody’s ADHD and executive dysfunction affect his daily life. Specifically, I have seen Cody [Specific Receipt: e.g., become overwhelmed by unorganized paperwork or rely heavily on clear, mailed instructions to stay on track]. It is my observation that Cody is highly responsive to formal mail but can easily miss “irregular” notice like a knock at the door or a paper left on the ground.

  7. Observation of Removal: I was aware of/witnessed Cody being removed from the home on December 9, 2025. Based on my constant contact with him, he appeared completely blindsided by this action, which is consistent with his claim that he was never served.
